Madar (Rabat) - Morocco's Constitutional Court, in decision No. 294/26 issued on Wednesday, November 4, 2026, declared vacant the House of Representatives seat held by Head of Government Fatima-Zahra El Mansouri, as well as the seats of MPs who joined the government, news site Hespress reported on Thursday, November 5.

According to the same source, the decision covers nine MPs appointed to the government on October 16, 2026: Abdellatif Ouahbi, Ryad Mezzour, Mehdi Bensaid, Azzeddine El Midaoui, Abdessamad Kayouh, Abderrahim Chahid, Najwa Koukous, Omar Hejira and Rachid Hammouni, bringing the total to ten seats including the Head of Government's.

The ruling rests on Article 14 of the organic law on the House of Representatives, which makes a parliamentary seat incompatible with a government post. The vacancy was declared at the request of the House speaker.

The court rejected as inadmissible the request concerning MP Madiha Khayr, who was appointed to the government on October 16 and relieved of her ministerial duties on October 18, because the speaker's request was registered on October 23, after her removal, and did not meet the legal condition for starting the procedure.

In a separate decision on November 3, the court had declared vacant the Larache seat of Nizar Baraka, minister of equipment, water and forests. The ruling also covers requests concerning MPs' resignations, whose names the source did not give, and the court found those seats vacant.

The decision is to be notified to the parties concerned and published in the Official Bulletin. The source did not say how the vacant seats will be filled.
